Refund and Cancellation

This Refund and Cancellation Policy (“Policy”) explains how subscriptions, free trials, cancellations, refunds, billing issues, and paid or metered features work for LingoYoga.

LingoYoga is operated by RazonX DevHaus Private Limited, a company incorporated in India, having its registered office at: B-42/2, 1st Floor, Double Storey, Ramesh Nagar, New Delhi, West Delhi, Delhi, India 110015 (“RazonX”, “LingoYoga”, “we”, “us”, or “our”).

This Policy forms part of, and should be read together with, our Terms and Conditions (“Terms”) and our Privacy Policy. Capitalised terms not defined in this Policy have the meanings given to them in the Terms.

We have included a plain-English summary at the end of this Policy for convenience. That summary is not a substitute for this Policy and does not limit, replace, or modify the provisions below. If the summary conflicts with this Policy, this Policy will prevail.

1. Scope of this Policy

This Policy applies to:

  1. paid LingoYoga subscriptions;
  2. free trials;
  3. subscription renewals;
  4. cancellations;
  5. refund requests;
  6. billing errors;
  7. duplicate charges;
  8. technical non-delivery of paid access; and
  9. future paid, metered, credit-based, or usage-based features.

Payments may be processed by a merchant of record, a payment processor, an app store, or another third-party payment provider. Where a third-party provider processes your payment, that provider’s terms, refund rules, cancellation process, payment timelines, tax treatment, and dispute procedures may also apply.

2. Free Trial

We may offer a 14-day free trial for eligible users.

If you start a free trial, you may be required to provide valid payment details before or during the trial.

Unless you cancel before the free trial ends, your paid subscription may begin automatically at the end of the trial, and you may be charged the applicable subscription fee.

You are responsible for cancelling before the trial ends if you do not wish to continue with a paid subscription.

We may limit free-trial eligibility, including where we reasonably believe that a user is abusing free trials, creating duplicate accounts, using false information, or attempting to bypass eligibility rules.

3. Subscriptions and Auto-Renewal

At launch, LingoYoga subscriptions are intended to be offered on a monthly basis, unless otherwise stated at checkout.

Your subscription renews automatically at the end of each billing period unless cancelled before renewal in accordance with this Policy, the Terms, and the applicable payment-provider or app-store rules.

The applicable price, currency, taxes, billing period, renewal terms, and cancellation method will be shown at or before checkout.

Your access to paid features continues only while your subscription remains active, paid, and in good standing.

4. How to Cancel

You may cancel your subscription through:

  1. your LingoYoga account settings, where an in-app cancellation tool is available;
  2. the merchant of record, payment provider, or app store through which you subscribed; or
  3. any other cancellation method shown at checkout or in your account.

If you subscribed through a merchant of record, payment processor, or app store, you may need to cancel through that provider. We may not be able to cancel a third-party-managed subscription directly from our systems.

Cancellation stops future renewals. Unless otherwise stated or required by applicable law, cancellation does not automatically create a refund for the current or past billing period.

5. Effect of Cancellation

If you cancel your subscription, you will generally retain access to the applicable paid features until the end of the then-current billing period, unless:

  1. your payment is reversed, disputed, refunded, or charged back;
  2. your account is suspended or terminated for breach of the Terms;
  3. access must be withdrawn for legal, security, fraud-prevention, or payment-compliance reasons; or
  4. the applicable payment provider or app store applies a different rule.

After your subscription ends, your account may be downgraded to a free plan, limited-access mode, or inactive status, depending on the features available at that time.

Some paid features, exports, downloads, usage limits, review modes, audio features, or advanced tools may become unavailable after cancellation or expiry of your paid subscription.

6. General Refund Position

Because LingoYoga may provide a 14-day free trial, users are expected to evaluate the Services during the trial period before paid billing begins.

Unless otherwise required by applicable law or expressly stated in this Policy:

  1. subscription fees are generally non-refundable after the free trial ends;
  2. we do not provide refunds or credits for partial billing periods;
  3. failure to use the Services during a billing period does not create a refund right;
  4. dissatisfaction with learning progress does not create a refund right;
  5. cancellation stops future renewals but does not automatically refund past charges; and
  6. refunds are not provided merely because a user forgot to cancel before renewal.

This does not affect any mandatory consumer rights that cannot be excluded under applicable law.

7. Refunds We May Approve

We may approve a refund, credit, reversal, or billing correction where we determine, or where the applicable payment provider determines, that:

  1. you were charged twice for the same subscription period;
  2. you were charged an incorrect amount due to a billing error;
  3. you were charged after properly cancelling in accordance with the applicable cancellation process;
  4. you paid for access but did not receive the paid access due to a material technical failure attributable to us;
  5. the payment was unauthorised, fraudulent, or processed in error;
  6. a refund is required by applicable law; or
  7. exceptional circumstances justify a refund at our discretion.

We may require reasonable information to verify the issue, including transaction ID, payment email, screenshot, invoice, receipt, billing date, payment provider, and account details.

8. Technical Non-Delivery

A technical issue does not automatically create a refund right.

For a refund based on technical non-delivery, the issue must materially prevent access to a paid feature or paid subscription benefit, and you must reasonably cooperate with us or the payment provider to verify and resolve the issue.

We may decline a refund where the issue is caused by:

  1. your device, browser, operating system, internet connection, settings, extensions, firewall, VPN, or local environment;
  2. your failure to update or use a supported browser or device;
  3. your loss of account access due to forgotten credentials, incorrect login method, or user-side authentication issues;
  4. your breach of the Terms;
  5. third-party outages outside our reasonable control, unless applicable law requires otherwise; or
  6. temporary downtime, maintenance, or minor interruptions that do not materially prevent paid access.

Where a material technical issue is confirmed, we may, at our discretion and subject to applicable law:

  1. restore access;
  2. extend access;
  3. issue a credit;
  4. process a refund; or
  5. provide another reasonable remedy.

9. Third-Party APIs, AI, Audio, TTS, STT, and Metered Features

LingoYoga may introduce paid, metered, usage-based, or credit-based features in the future, including text-to-speech, audio downloads, speech tools, AI-assisted features, pronunciation tools, or other API-dependent features.

Such features may involve third-party providers and may be subject to additional usage limits, fair-use rules, credit rules, fees, or feature-specific terms.

Unless otherwise required by applicable law or expressly stated in feature-specific terms:

  1. consumed credits, generated audio, completed API calls, used download allowances, or metered usage may be non-refundable;
  2. dissatisfaction with the quality, pronunciation, naturalness, accent, speed, tone, translation, speech-recognition result, AI-generated output, or third-party API output does not automatically create a refund right;
  3. temporary unavailability, delay, degraded performance, rate limiting, or output variation of a third-party API does not automatically create a refund right; and
  4. we may modify, pause, limit, replace, or discontinue API-dependent features where third-party costs, limits, availability, quality, legal requirements, or provider policies change.

Any mandatory refund, cancellation, or consumer rights that cannot lawfully be excluded will continue to apply.

10. Payment Provider and Merchant of Record Rules

If your payment is processed by a merchant of record, a payment processor, or an app store, refunds may be subject to that provider’s terms, refund rules, timelines, tax treatment, and approval process.

In some cases:

  1. refund requests must be submitted directly to the payment provider or app store;
  2. we may not be able to issue a refund directly;
  3. taxes, foreign-exchange differences, banking fees, payment-provider fees, or app-store rules may affect the amount or timing of refunds;
  4. the refund may be returned to the original payment method; and
  5. refund processing times may depend on banks, card networks, payment providers, app stores, or applicable law.

We are not responsible for delays or failures caused by banks, card networks, payment providers, app stores, or other third parties outside our reasonable control.

11. Chargebacks and Payment Disputes

If you dispute a charge, initiate a chargeback, reverse a payment, or report a transaction as unauthorised, we or the applicable payment provider may suspend, restrict, or terminate your access to paid features while the issue is investigated.

You should contact us at help@lingoyoga.com before initiating a chargeback so that we can try to resolve the issue.

We may treat abusive, fraudulent, repeated, or bad-faith chargebacks as a breach of the Terms.

Where a chargeback or payment dispute is resolved against you, you may remain responsible for the applicable fees, taxes, costs, and any reasonable administrative or recovery costs permitted by applicable law.

12. Pricing, Promotions, and Payment Abuse

LingoYoga may offer localised pricing, purchasing-power-adjusted pricing, regional offers, country-specific pricing, promotional pricing, free trials, coupons, or other payment benefits.

Your use of localised pricing, PPP pricing, promotions, free trials, refunds, chargebacks, and payment systems is governed by the Terms, including the provisions on localised pricing, PPP pricing, and abuse prevention.

If we reasonably suspect pricing abuse, promotion abuse, refund abuse, free-trial abuse, chargeback abuse, payment abuse, fraud, false account information, or any attempt to obtain pricing or access not intended for your actual location or eligibility, we may, to the fullest extent permitted by applicable law:

  1. refuse a refund;
  2. cancel or reverse a transaction;
  3. suspend, restrict, or terminate your account;
  4. revoke access to paid features;
  5. require additional verification; and
  6. take any other action permitted under the Terms.

13. Plan Changes, Downgrades, and Upgrades

We may offer plan changes, upgrades, downgrades, add-ons, paid feature packs, or usage-based features in the future.

The billing effect of a plan change will be shown at or before checkout, or will be governed by the applicable payment provider’s rules.

Unless otherwise stated:

  1. upgrades may take effect immediately;
  2. downgrades may take effect at the end of the current billing period;
  3. unused time may not be refundable;
  4. promotional pricing may not carry over to another plan; and
  5. some features or usage limits may change when your plan changes.

14. Promotions, Discounts, and Coupons

We may offer promotions, discounts, coupons, referral offers, regional offers, or special pricing from time to time.

Promotional offers may be subject to additional terms, eligibility rules, expiry dates, regional limits, usage limits, and payment-provider rules.

Unless expressly stated:

  1. promotions apply only prospectively;
  2. promotions cannot be exchanged for cash;
  3. promotions cannot be combined with other offers;
  4. promotions cannot be applied retroactively to past payments; and
  5. we may modify or withdraw promotions where permitted by applicable law.

15. Taxes, Currency, and Foreign Exchange

Prices may be shown inclusive or exclusive of applicable taxes depending on your location, payment provider, and checkout flow.

You are responsible for any taxes, duties, fees, charges, or similar amounts applicable to your purchase, except where the merchant of record, payment provider, or applicable law requires otherwise.

Foreign-exchange rates, bank charges, card fees, international transaction fees, and payment-provider fees are determined by third parties and are not controlled by us.

Refund amounts may differ from the original charge because of taxes, currency conversion, bank fees, card-network rules, or payment-provider rules.

16. Account Deletion and Subscriptions

Deleting your LingoYoga account is not the same as cancelling your subscription.

If your subscription is processed by a merchant of record, payment provider, or app store, you may need to cancel the subscription separately through that provider before deleting your account.

If you delete your account without cancelling your subscription, you may continue to be charged until the subscription is properly cancelled through the applicable process.

Account deletion may result in loss of access to your flashcards, learning progress, review history, subscription-linked features, and other account data.

The deletion, retention, de-identification, and backup handling of personal data associated with your account are described in our Privacy Policy.

17. How to Request a Refund

To request a refund from us, contact help@lingoyoga.com with:

  1. the email address linked to your LingoYoga account;
  2. the payment email, if different;
  3. the date and amount of the charge;
  4. the transaction ID, invoice, receipt, or payment-provider reference;
  5. the payment provider or app store used;
  6. a short explanation of the issue; and
  7. any supporting screenshots or documents.

We may ask for additional information to verify the request.

If your payment was processed by a merchant of record, payment provider, or app store, we may direct you to that provider’s refund process.

18. Refund Review and Processing Timeline

We will review refund requests within a reasonable period after receiving the necessary information.

If a refund is approved, it will generally be processed through the original payment method or through the applicable payment provider’s refund process, unless another method is required or permitted by applicable law.

Refund processing times may vary depending on banks, card networks, payment providers, app stores, tax rules, and your country.

We do not guarantee that funds will appear in your account immediately after a refund is approved.

19. Mandatory Consumer Rights

Nothing in this Policy limits, excludes, or restricts any refund, cancellation, withdrawal, chargeback, or consumer-protection right that cannot lawfully be limited, excluded, or restricted under applicable law.

If this Policy conflicts with a mandatory right available to you under applicable law, that mandatory right will prevail only to the extent of the conflict.

20. Changes to this Policy

We may update this Policy from time to time to reflect changes in the Services, pricing, payment providers, subscription model, legal requirements, or business operations.

If we make material changes, we may notify you by email, in-app notice, website notice, or other reasonable means.

The updated Policy will be effective from the date stated at the top, unless otherwise specified.

Your continued use of the Services after the updated Policy becomes effective means you acknowledge the updated Policy.

  11. A technical issue creates a refund right only where it materially prevents access to a paid feature or paid subscription benefit and the issue is verified.
  12. Future paid, metered, credit-based, AI, audio, speech, TTS, STT, or API-dependent features may have separate usage limits and refund rules.
  13. Consumed credits, generated audio, completed API calls, used download allowances, or metered usage may be non-refundable unless required by law or expressly stated otherwise.
  14. Dissatisfaction with AI, audio, speech, pronunciation, translation, or third-party API output does not automatically create a refund right.
  15. Refund timing and processing may depend on banks, card networks, payment providers, app stores, tax rules, and your country.
  16. Abuse of PPP pricing, promotions, free trials, refunds, chargebacks, payment systems, VPNs, proxies, or false account information may lead to refund refusal, account restriction, suspension, or termination.
  17. Nothing in this Policy limits any mandatory consumer rights that cannot lawfully be excluded or restricted.
